What is building Mediation?
Building Mediation is a guided negotiation process for a dispute or set of disputes between two or more parties. In mediation, the parties in dispute meet in the presence of one of our unbiased, independent mediators, who as Licensed Builders and Accredited Mediators have extensive experience and specialist knowledge in understanding the disputed building issues. This is incredibly important in achieving a resolution as utilising one of our building specific mediators enables:
- Explanation of the building issues clearly and succinctly to promote understanding for the basis of the dispute
- Narrowing issues down to the point of specific building contention
- Provide suitable options and alternatives
- Enact problem solving techniques to assist in dispute resolution
The intent of the mediation process is not to force disputing parties into resolving issues, but rather create a safe, confidential and reciprocal environment for parties to respectfully discuss and try to resolve their problems. Our mediators are present during the mediation to control the process, but it is the participants who decide on any outcomes that are to be agreed.
Our mediation services are often performed on site where the dispute has arisen, which gives parties an opportunity to understand both sides of the argument and work towards a mutual resolution.
Is mediation a formal court like process?
No. Our mediation process is much less formal than NCAT or court hearings. Unlike NCAT or court hearings, mediation offers the flexibility of location which is why often our mediation is performed on site where issues can be systematically reviewed and discussed under the control of one of our mediators.
Mediation is often a significantly more cost-effective approach to dispute resolution when compared to going to court. Our mediators are all Accredited in Mediation by recognised training providers and also have active NSW Builders Licenses.
